This agreement has been arranged between Çözüm Market Bilgisayar Sistemleri Sanayi ve Danışmanlık Ticaret Limited Şirketi, the owner and operator of the sonuc.triatlon.org.tr website, and the internet user ("member") who registers on the sonuc.triatlon.org.tr ("Turkey Triathlon Federation") website, and has been executed and mutually entered into force upon electronic approval by the member.
Every Turkey Triathlon Federation member also accepts and undertakes all declarations stated in the declarations mentioned in this Membership Agreement ("Agreement") concluded in electronic form.
The subject of this agreement is the determination of the services offered on the sonuc.triatlon.org.tr website, the conditions for benefiting from these services, and the rights and obligations of the parties. The scope of this agreement includes this agreement itself and all notices, writings, and explanatory statements made by the "Turkey Triathlon Federation" regarding usage, membership, and services within the site. By accepting the provisions of this agreement, the member also accepts all statements disclosed by the "Turkey Triathlon Federation" regarding usage, membership, and services within the site.
The member agrees that throughout their membership, while benefiting from the site's services and performing any transaction related to the services on the site, they will act in accordance with all conditions set forth in this agreement, the rules specified in the relevant sections of the site, and all applicable legislation, and that they understand and approve all terms and rules defined by this agreement.
In order to become a member of the site, the user's membership must not have been previously cancelled pursuant to the provisions of this agreement. Persons whose membership has been previously cancelled shall not attain membership status even if they complete the membership registration process and approve this agreement.
The member acknowledges that in cases where the Turkey Triathlon Federation is obliged to make disclosures to official authorities pursuant to applicable mandatory legislation, the Turkey Triathlon Federation shall be authorized to disclose personal/confidential/private/commercial information belonging to members to official authorities upon duly submitted requests by such authorities through the system, and that no compensation may be claimed from the Turkey Triathlon Federation under any title whatsoever for this reason.
The member may not copy, reproduce, distribute free of charge or for a fee, or publish or share on other websites the sample files contained in training sets for any purpose other than personal learning. Furthermore, for any reason whatsoever, the member may not download any video on the Turkey Triathlon Federation platform to their computer.
Members are solely responsible for the security, storage, keeping away from third parties, and use of the system access tools (username, password, etc.) they use to benefit from the services offered by the Turkey Triathlon Federation through the site. The Turkey Triathlon Federation bears no direct or indirect responsibility for any damages suffered or that may be suffered by members and/or third parties due to any negligence or fault of members regarding the security, storage, keeping away from third parties, and use of system access tools.
Every Turkey Triathlon Federation user is assigned an "email address" and a "password." "Email addresses" are unique to each member and the same "email address" cannot be used by different members.
Without the written consent of the Turkey Triathlon Federation, the member may not partially or fully transfer this agreement or the rights and obligations under this agreement, or member credentials, to any third party; membership cannot be made available for use by persons other than the "member" themselves. The Turkey Triathlon Federation shall not be held directly and/or indirectly responsible in any way for damages suffered or that may be suffered by third parties as a result of such transfers or unauthorized use. The membership of a member found to have allowed another person to use or to have transferred their membership shall be cancelled upon detection of such actions.
Every "member" accepts and undertakes that they will not reproduce, copy, distribute, or process images, texts, visual and audio materials, video clips, files, databases, catalogues, and lists contained within the site that would constitute an infringement of the property or personal rights or assets of the Turkey Triathlon Federation and/or any other third party, and will not, through these actions or any other means, enter into direct and/or indirect competition with the Turkey Triathlon Federation. The Turkey Triathlon Federation shall not be held directly and/or indirectly responsible in any way for damages suffered or that may be suffered by third parties as a result of activities carried out by members on the site in violation of the provisions of this agreement and the law.
Every user must enter their registered email address and password in order to connect to systems requiring Turkey Triathlon Federation membership. This process is defined as logging in to the Turkey Triathlon Federation system. The "Password" is known only to the relevant user. If the user's password is forgotten, the Turkey Triathlon Federation will, upon request, send a link to the user's email address registered in the Turkey Triathlon Federation system to create a new password. The determination and protection of the Password is entirely the user's own responsibility, and the Turkey Triathlon Federation is absolutely not responsible for problems arising from or damages that may occur due to password use.
The Turkey Triathlon Federation may notify its members of new services or projects within the Turkey Triathlon Federation and Çözüm Market Bilgisayar Sistemleri Sanayi ve Danışmanlık Ticaret Limited Şirketi system via all communication channels shared by members with the Turkey Triathlon Federation system, including email, SMS, and social media channels. Additionally, it may share various promotional, campaign, and similar information.
The Turkey Triathlon Federation owns all intellectual property rights to the data and information generated through the use of the Turkey Triathlon Federation system. The Turkey Triathlon Federation may prepare reports containing demographic information without disclosing user membership information, or may use such information or reports itself, and may share these reports and/or statistics with business partners and third parties with or without charge.
Every member accepts and undertakes that they will not reproduce, copy, distribute, or process images, texts, visual and audio materials, video clips, files, databases, catalogues, and lists contained within the site that would constitute an infringement of the property or personal rights or assets of the Turkey Triathlon Federation and/or any other third party, and will not, through these actions or any other means, engage in actions that would directly and/or indirectly harm the Turkey Triathlon Federation and third parties. The Turkey Triathlon Federation shall not be held directly and/or indirectly responsible in any way for damages suffered or that may be suffered by third parties as a result of activities carried out by members on the site in violation of the provisions of this agreement and the law.
The Turkey Triathlon Federation reserves the right to change the services and content offered on the site at any time. The Turkey Triathlon Federation may exercise this right without any notice or prior notice period. Members are required to promptly implement the changes and/or corrections requested by the Turkey Triathlon Federation. Changes and/or corrections requested by the Turkey Triathlon Federation may, if deemed necessary, be made directly by the Turkey Triathlon Federation itself. All damages, legal and criminal liabilities arising or that may arise from members' failure to timely implement changes and/or corrections requested by the Turkey Triathlon Federation shall belong entirely to the members themselves.
The Turkey Triathlon Federation bears no responsibility for portals, websites, files, and content accessed via links (links, banners, recommendations) on the site and videos, or for services or products offered by or the content of portals or websites accessed through such links. The existence of links to other sites does not mean that the Turkey Triathlon Federation endorses the content of the linked sites.
The Turkey Triathlon Federation may use member information on the site in any manner it sees fit for security, fulfillment of its obligations, and certain statistical evaluations; it may classify and store such information in a database.
Information provided by the member during the membership registration procedures may be used for the purpose of advertising and marketing the site. Members who do not wish their information to be used may notify this request by sending an email to destek@TurkiyeTriatlonFederasyonu.com.tr, after which their information will not be used for advertising and marketing purposes.
There may be interruptions in the "Site's" broadcasts due to technical problems. The "Turkey Triathlon Federation" shall not be held responsible for problems experienced by the "Member" related to communication and access to the "Site" arising from such interruptions.
The Turkey Triathlon Federation reserves the right to offer, in addition to standard membership on the site, a special membership service purchased for a certain fee that grants more rights than standard members.
Any images, text, photographs, and other materials published on the sonuc.triatlon.org.tr site may not be published on other websites or in conventional media such as newspapers, television, radio, or magazines without the permission of the Turkey Triathlon Federation. All content on the site is protected under Article 4, Paragraph 7 of the Law on Intellectual and Artistic Works No. 1482, which covers "databases resulting from the selection and compilation of data and materials according to a specific purpose and a special plan, readable by a machine or in other forms," and content of a work nature is additionally subject to legal protection.
All elements of the site (including but not limited to content, sample files, design, text, images, HTML code, and other codes) (works subject to the intellectual property rights of the Turkey Triathlon Federation) belong to the Turkey Triathlon Federation and/or are used by the Turkey Triathlon Federation under a license obtained from a third party.
Members may not resell, share, distribute, display, or allow others to access or use the services provided through the site, the information on the site, or the works subject to the Turkey Triathlon Federation's intellectual property rights; otherwise, they shall be obliged to cover the compensation amount claimed from the Turkey Triathlon Federation by third parties, including licensors, for damages suffered, including court costs and attorney fees. Members may not reproduce, distribute, or create or prepare derivative works from the works subject to the Turkey Triathlon Federation's intellectual property rights.
The Turkey Triathlon Federation reserves all rights over all its assets, including the services provided through the site, the information on the site, works subject to the Turkey Triathlon Federation's intellectual property rights, Turkey Triathlon Federation trademarks, the commercial appearance of the site, and all material and intellectual property rights, property rights, personal rights, trade secrets, and know-how acquired through the site.
The Turkey Triathlon Federation may, entirely at its own discretion and unilaterally, amend this agreement at any time it deems appropriate by announcing the changes on the site. The amended provisions of this agreement shall become effective on the date they are announced, while the remaining provisions shall continue in force and produce their effects unchanged. This agreement may not be amended by unilateral declarations of members.
In all cases considered as force majeure under law, the Turkey Triathlon Federation shall not be liable for late or incomplete performance or non-performance of any of its obligations defined by this agreement. Such and similar circumstances shall not be deemed as delay, incomplete performance, non-performance, or default for the Turkey Triathlon Federation, nor shall any compensation be claimed from the Turkey Triathlon Federation under any title for such circumstances. The term "force majeure" shall be interpreted as events beyond the reasonable control of the relevant party and that the Turkey Triathlon Federation could not prevent despite exercising due diligence, including but not limited to natural disasters, riots, war, strikes, communication problems, infrastructure and internet failures, power outages, and adverse weather conditions.
Turkiye Law shall apply in the implementation, interpretation, and management of legal relations arising under this agreement. In the event of any dispute arising or that may arise from this agreement, the Istanbul (Çağlayan) Courts and Enforcement Offices shall have jurisdiction.
This agreement shall remain in force until the member's membership is cancelled and shall continue to produce its effects between the parties, and shall be deemed terminated upon the expiry of the member's membership period or in cases of temporary or permanent suspension of membership.
The Turkey Triathlon Federation may unilaterally terminate the agreement in the event that members violate the provisions specified in this agreement and similar rules regarding usage, membership, and services within the site, and members shall be obliged to compensate all damages suffered by the Turkey Triathlon Federation due to such termination.
